Terms of Service
Definitions
- Company: when these terms mention “Company,” “we,” “us,” or “our,” it refers to Anchor Point Agency, LLC, Fort Mill, SC 29708, United States.
- Service or Services: refers to any or all of the Anchor Point services as described in the relative terms (if available) and on the Anchor Point website.
- Website: The Anchor Point site, which can be accessed via this URL: https://www.getanchorpoint.com
- You: a person or entity that is accessing the Service.
- Subscription: refers to paid access to one or more of our monthly fixed-price Services.
- Task or Tasks: refers to one or more eligible Webflow design/development work requests.
- Deliver or Delivery: refers to our notification to you of the completion of a Task.
- Queue: refers to a list of Tasks ordered by priority of Delivery, first to last.
- Revision or Revisions: refers to any amendments requested to a delivered Task
- Unlimited: refers to the number of Tasks that you may request us to work on, one-at-a-time, under any of our Subscription Services.
- Pre-Paid: refers to an upfront purchase of Webflow-related design & development time.
- User Content: means information submitted by you as part of a Task, including but not limited to, the task description, designs & design assets, photography, video, and website copy.
General Terms
How our Services Work
We offer Webflow design & development Services under both Subscription plans and Pre-Paid packages.
For our Subscription plans, we enable you to subscribe to a Webflow design & development Service for a fixed monthly-recurring cost, enabling Unlimited eligible Tasks from your Queue to be completed while your Subscription is active.
For our Pre-Paid packages, we enable you to make an upfront purchase of
Webflow-related design & development time at a discounted rate, enabling Tasks from your Queue to be completed until there is insufficient time left to complete the next Task in your Queue.
The Services work as follows:
- You subscribe to one of our Subscription plans or purchase one of our Pre-Paid packages;
- You submit one or more Tasks to your Queue, in order of priority;
- We start working on the Task;
- We deliver the completed Task, at which point you should:some text
- Accept the Delivery as completed;
- Reject the Delivery as incomplete, and provide details of any Revisions required before you are able to accept the Delivery;
- Once the Delivery has been accepted, we start working on the next Task in your Queue;
Making Requests
Each Request added to your Queue should consist of a detailed description of the Task, accompanied by any user Content that will be required for us to Deliver the Task.
If the Task refers to an existing page or design, we request that you create a Loom video to help explain the Task visually. By explaining the request in as much detail as possible, you will help us Deliver the Task with minimal delays.
Webflow Access
In order for us to efficiently deliver Tasks, we require you to provide a paid admin seat on your Webflow Workspace for us so that we are able to add/remove additional members of our team as free guests on your Workspace as may be required to complete each task.
For both security and accountability reasons, we will not work on your site using any Webflow credentials that have been provided by yourself. Each of our team members have their own Webflow account, and are responsible for maintaining the security of their credentials. Should we become aware of a possible security breach that might affect you, we will notify you as soon as possible within 48 hours of us becoming aware of such, and you will have the right to request an incident report.
Communication
You will be assigned a Project Manager who will be your point-of-call for all communication regarding the Service.
You will have access to contact your Project Manager via Slack or email.
Depending on the plan that you have subscribed to or the package that you have purchased, you may also have the option to schedule a video call with your Project Manager to discuss a particular Task or Tasks. We will do our best to accommodate your schedule, however all calls must start & finish between the hours of 10am and 4pm, Monday to Friday, and times may be limited by the availability of your Project Manager’s schedule.
Delivery Time
We will endeavor to Deliver Tasks as quickly as possible, but turnaround time will depend upon the complexity of the Task, and each Revision request will operate under the same process. Upon starting a new Task, we will provide you with an estimated date for Delivery.
If, while working on a Task, you decide that another Task should take priority, you should notify us immediately. We will then pause working on the current Task and start working on the priority Task instead.
We will endeavor to start working on a new Task the same or next working day following notification of the Task or completion of the previous Task in your Queue, however please note that Subscription Plans take priority over Pre-Paid packages, so Tasks may take longer to Deliver on Pre-Paid packages if available resources are limited.
Working Hours
Your Project Manager will generally be available during standard United States (Eastern Timezone) business hours. However, we do shut down completely between Christmas & New Year to give our team a well-earned break.
With a globally-distributed team, we also respect each team member’s own national & religious holidays. This does not always mean that we will be unable to service your requests, however it may impact delivery times.
We also get our team together for occasional events. We will give you as much notice as possible of these to allow you to plan ahead and minimize any potential disruption to delivery schedules.
Individual Plan & Package Terms
Depending on the plan that you have subscribed to or the package that you have purchased, there may be additional terms & conditions which are outlined below.
Anchor Point Pre-Paid Package
- Covers any kind of Webflow-related design & development work.
- Asynchronous communication via Slack or email, or scheduled real-time video calls via Zoom, Sessions, meet.Jasn.io, or Google Meet (calls are billable and will be deducted from unused time).
Payment
The Services require payment before you can access or use them.
You may purchase a paid Subscription by paying a Subscription fee in advance on a monthly, yearly or other basis or some other recurring interval disclosed to you prior to
your purchase on the website. We may change the price of the Subscription fee, at our sole discretion, with thirty days notice. If you do not agree with a price change, you have the right to reject the change by unsubscribing from the Subscription prior to the price change.
The available Payment Methods are Direct Debit or Stripe, with VAT invoices provided via email.
Refund Policy
We provide a refund period, disclosed to you prior to your purchase on the website. Should you not be happy with the Services provided, you may request a full refund of all sums paid within this refund period, which starts from the day you sign-up to the Service. In this instance, we reserve the right to withhold any undelivered work, or retain any intellectual property rights for work already delivered.
Refunds are applicable for new Subscriptions only – continued use or renewal of the Subscription does not entitle you to receive a refund.
Beyond this refund period of your first Subscription, no refunds are possible under any circumstance, including unused time. Promotions, upgrades, and adjustments to existing plans are non-refundable. You are responsible to use the Service after payment.
Unused time on Pre-Paid packages expires twelve months from purchase, and is non-refundable.
Rights to User Content
By submitting a Task, you represent that you own the user Content or otherwise have the right to submit the user Content to us, and your use of the user Content does not violate any third party intellectual property or other rights.
You will maintain the ownership rights in any user Content submitted with a Task, but by submitting a Task, you give us the rights to use the user Content solely to the extent necessary to complete the Task. You also authorise us to retain archival copies of all user Content submitted for back-up purposes and to help us to complete your future Tasks more efficiently. Upon request from you, we will delete any archival copies of user Content.
Intellectual Property Rights
We guarantee that all elements of the work we deliver to you are either owned by us, or we have permission to provide them to you. Provided that you’ve paid for the Service and that these terms haven’t been breached, we’ll assign all intellectual property rights to you as follows:
- You’ll own the intellectual property rights to any design or code we specifically create for you as part of the Service.
- If we make use of any intellectual property rights we’ve developed prior to, or developed separately from this project and not paid for by you, we’ll licence its use to you, exclusively and in perpetuity for the related Webflow project only, unless we agree otherwise.
- If your site is based on a template purchased from a Template Marketplace, you agree to abide by the terms of that marketplace License agreement.
Term and Termination
Your Subscription will continue month-to-month unless and until you cancel your Subscription, or we terminate it. We will bill the monthly Subscription fee using the Payment Method used when signing up unless updated or changed by you. You must cancel your Subscription before it renews each month in order to avoid billing of the next month’s Subscription fees to your Payment Method.
With the exception of our money back guarantee (see Refunds Policy section above), monthly Subscriptions are not refundable.
If we are unable to collect a Subscription payment using your Payment Method, we will suspend your Subscription until payment is received. If we do not receive payment within twenty eight days of a failure to collect, we reserve the right to consider the Subscription as having been terminated.
If you wish to switch Subscription plans, you may do so on request, with changes taking effect at the start of the next billing cycle.
If you wish to terminate your Subscription, you must contact us with your termination request. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We may terminate or suspend any and all Services and/or your Subscription immediately, without prior notice or liability, for any reason whatsoever, or for no reason, including without limitation if you breach the Terms. Upon termination of your Subscription, your right to use the Services will cease on expiry of the prevailing billing month.
Changes To our Terms & Conditions
You acknowledge and agree that we may stop (permanently or temporarily) providing the Service (or any features within the Service) to you or to users generally at the
Company’s sole discretion, without prior notice to you. In this instance, we agree to refund you pro-rata for any unused portion of the Service already paid for.
We reserve the right, at our sole discretion, to modify or replace the Terms of Service at any time. If a revision is material we will provide at least thirty days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you should terminate your Subscription with immediate effect.
Agreement
You acknowledge and agree that you have read, understand and agree to be bound by these Terms of Service, and that any other person signing this Agreement has full authority to do so on your behalf.
